Erie County Sheriff Timothy Howard reports the arrest of a state of Rhode Island man for driving while intoxicated. This is the Erie County Sheriff's Office 123rd DWI arrest in 2013.

Deputies Daniel Harris and Richard Retzlaff  conducted a traffic stop on Transit Rd. in the Town of Lancaster after observing the vehicle's  tail lights were not working, the driver failed to use his turn signal properly and the driver failed to stay within his lane.  The officers found the driver, 37 yr. old Hans Benonisen, to be intoxicated, so he was taken into custody.  Mr. Benonisen refused to submit to a chemical breath test.  Mr. Benonisen was charged with driving while intoxicated and several other vehicle and traffic violations.

Damage to Mr. Benonisen's vehicle had been observed by the deputies and Cheektowaga P.D. advised the Erie County Sheriff's that the same vehicle had been involved in a hit and run accident in the Town of Cheektowaga.  Mr. Benonisen was released on uniform traffic tickets returnable to the Town of Lancaster Court at a future date and then turned over to Cheektowaga P.D. where he faced further charges.
