Sheriff Timothy B. Howards reports the arrest of a Town of Sardinia man for Felony DWI while operating an ATV.  This is the 196th DWI arrest by Erie Co. Sheriff's Office in 2013.

While on patrol on Savage Rd. in the Town of Sardinia, Deputy Todd Jones observed an ATV being operated on the public roadway.  When Deputy Jones attempted to stop and speak w/ the operator, 40 yr. old John Murphy, he took off.  Mr. Murphy was located with the assistance of Deputies Jeffrey Ely, Donald Hoelscher and the New York State Police.  Upon further investigation, Mr. Murphy was found to be intoxicated and was taken into custody.  Mr. Murphy refused to submit to a chemical breath test and was charged w/ multiple ATV vehicle and traffic charges, Felony Aggravated Unlicensed Opertion and Felony DWI.  The charges rose to the felony level due to two prior DWI convictions, one in November of 2010 and the other in December of 2010.  Mr. Murphy was released to a third party on uniform traffic tickets returnable to the Town of Sardinia Court at a later date.
