Erie Co. Sheriff Timothy B. Howard reports the arrest of a Basom man for Felony Driving While Intoxicated.  This is the 225th DWI arrest made by the Erie County Sheriff’s in 2013.

Erie Co Sheriff’s Deputy Gene Nati responded to a complaint of a vehicle on it’s side in the road ditch on Cedar St. @ Koepsel Rd. in the Town of Newstead.  The driver left the scene before patrol’s arrival and was located with the assistance of the New York State Police within a few minutes.  The driver, 23 yr. old Cody Sundown, was found to be intoxicated and taken into custody.  Mr. Sundown refused to submit to any standardized field sobriety tests and refused to submit to a chemical breath test.  After being arrested for Felony DWI , Felony Aggravated Unlicensed Operation and numerous other vehicle and traffic charges, Mr. Sundown was taken to the Erie County Holding Center pending arraignment.  The DWI was a felony due to a prior conviction of DWI in October of 2011.  Mr. Sundown will be arraigned at a future date in the Town of Newstead Court.
